EditLuma Terms of Service

These terms describe the conditions for using EditLuma's AI image generation, enhancement, credit, and payment features.

1. Purpose

These Terms govern the rights, obligations, and responsibilities between EditLuma (the "Company") and users of the AI image generation and editing service (the "Service").

2. Definitions

  1. "Service" means AI-based image generation, enhancement, upscaling, style transfer, storage, credit top-up, and related features provided by the Company.
  2. "User" means any person who accesses or uses the Service.
  3. "Member" means a user who has created an account and entered into a service agreement with the Company.
  4. "Credits" means the digital usage units deducted when paid features are used.
  5. "Paid Credits" means credits purchased by a member, and "Free Credits" means credits granted by the Company through sign-up bonuses, events, or promotions.

3. Posting and Amendment of Terms

  1. The Company will make these Terms available through the Service or a linked page so users can review them easily.
  2. The Company may amend these Terms to the extent permitted by applicable law.
  3. When the Terms are amended, the effective date and reason for amendment will be announced at least 7 days in advance. Changes that materially disadvantage users may be announced 30 days in advance.

4. Services Provided

  1. AI image generation
  2. AI enhancement, upscaling, retouching, and style transfer
  3. Storage, retrieval, and gallery access for generated or edited outputs
  4. Credit top-up, usage history, and purchase history features
  5. Other related features determined by the Company

5. Account Formation

  1. A service agreement is formed when a user agrees to these Terms, applies for membership, and the Company accepts the application.
  2. The Company may refuse registration or terminate an account after the fact in cases such as:
  3. impersonation or submission of false information,
  4. interference with normal service operations or a substantial risk of such interference,
  5. use for purposes prohibited by law or these Terms, or
  6. other cases reasonably deemed inappropriate by the Company.

6. Credits, Pricing, and Payments

  1. Paid features require credits, and deduction rules are shown on the relevant feature screen or pricing page.
  2. The Company may grant free credits to new users, subject to conditions stated in the Service or separate notices.
  3. Prices, package composition, and quantities of paid credits are shown on the checkout screen and may change under the Company's operating policies.
  4. Payments are processed through Polar or another payment provider designated by the Company.
  5. Unless otherwise stated, paid credits do not expire. Free or promotional credits may be subject to separate conditions or expiration periods.
  6. Payment cancellations caused by the user's own circumstances, exchange-rate differences, or card issuer fees are handled according to applicable law and payment provider policy.

7. Refund Policy

  1. A member may request a full refund within 7 days of purchase only if none of the paid credits from that purchase have been used.
  2. If any portion of the purchased credits has been used, partial refunds are generally not available unless required by law.
  3. Refunds are processed to the original payment method after Company review and payment provider processing.
  4. The actual completion time of a refund may vary depending on the card issuer, payment provider, or financial institution.
  5. Because AI outputs vary depending on prompts, settings, and model behavior, subjective dissatisfaction with results alone does not automatically qualify for a refund.
  6. Free credits, promotional credits, and event credits are not refundable.
Repeated payment-refund cycles, suspected abuse, or payment misuse patterns may result in restrictions on service use.

8. User Obligations and Prohibited Conduct

  1. Users must comply with applicable law, these Terms, and all notices displayed in the Service.
  2. Users must not generate, store, or distribute unlawful content or content that infringes the rights of others.
  3. Users must not use bots, macros, scraping, or any abnormal method to use the Service or acquire credits improperly.
  4. Users must not impersonate others or abuse events or promotions through multiple accounts.
  5. Depending on the severity of the violation, the Company may issue warnings, temporary restrictions, permanent suspension, payment cancellation, or take legal action.

9. Intellectual Property and Outputs

  1. Rights in the Service, including software, design, trademarks, logos, text, and interface, belong to the Company or the legitimate rights holder.
  2. To the extent allowed by applicable law and third-party AI model terms, the user is responsible for the lawful use of outputs they generate.
  3. The Company does not claim ownership of outputs created by users, but users must ensure those outputs do not infringe copyrights, trademarks, portrait rights, publicity rights, or other third-party rights.
  4. Users bear legal responsibility for the use, publication, redistribution, and commercial use of content they upload or generate.

10. Privacy

The Company complies with applicable privacy laws. Details on collection, use, retention, deletion, and third-party sharing of personal information are set out in the separate Privacy Policy.

11. Service Changes and Suspension

  1. The Company may change all or part of the Service for operational or technical reasons.
  2. The Company may temporarily suspend the Service for maintenance, system repair, equipment failure, network issues, third-party outages, force majeure, or similar reasons.
  3. Where advance notice is possible, the Company will announce changes or interruptions through the Service or its notices page.

12. Limitation of Liability

  1. The Company is not liable where the Service cannot be provided due to force majeure such as natural disaster, war, terrorism, regulation, or power/network failure.
  2. The Company is not liable for service issues caused by the user's own actions, including poor account management or credential leakage.
  3. The Company does not guarantee the content, accuracy, legality, completeness, or fitness for a particular purpose of user-generated or uploaded content.
  4. Except in cases of willful misconduct or gross negligence under applicable law, the Company is not liable for loss of images or outputs caused by system failure, data loss, hacking, or server incidents.
  5. Users are responsible for third-party rights violations, defamation, privacy invasion, or unlawful acts arising from their generated or uploaded content.
  6. The Company has no duty to intervene in disputes between users or between users and third parties, and is not liable for related damages.

13. Termination and End of Service

  1. Members may request account deletion or termination of the service agreement at any time through the Service.
  2. The Company may terminate an account or restrict access after notice if a member violates these Terms or applicable law. In urgent cases, notice may follow the action.
  3. If the Company decides to discontinue the Service, it will generally announce this 30 days in advance.
  4. In the event of service termination, refunds or compensation for unused paid credits will be determined in accordance with applicable law, payment provider policy, and Company notices.
  5. If generated outputs remain downloadable for a limited period after service termination, the Company will announce that period separately.

14. Governing Law and Dispute Resolution

  1. The Company and users will first attempt to resolve disputes through good-faith consultation.
  2. Any unresolved dispute will be governed by and interpreted under the laws of the Republic of Korea.
  3. If litigation is necessary, the court with jurisdiction under the Korean Civil Procedure Act will be the court of first instance.
